NOTICE OF ORDER ADOPTING SURFACE WATER CONTROLS AND THE MIDDLE 

REPUBLICAN NATURAL RESOURCES DISTRICT INTEGRATED MANAGEMENT PLAN

 In accordance with Neb. Rev. Stat. § 46-744, notice is hereby given that the Nebraska Department of Natural Resources (Department) on December 11, 2015 issued an order adopting the Integrated Management Plan (IMP) jointly developed by the Department and Middle Republican Natural Resources District (MRNRD) along with the associated surface water controls contained within the IMP.  The order will be effective January 15, 2016. The modifications to the IMP and associated surface water controls will allow for full implementation of the United States Supreme Court ruling that modified the procedures used to account for water under the Compact as well as implementation of various elements contained within recent agreements reached with the states of Kansas and Colorado through the Republican River Compact Administration.

Modifications to the surface water controls include: 1) the utilization of Department records to monitor surface water use; 2) greater flexibility in the Department’s regulation and administration of surface; and 3) A new surface water control that provides for the Department’s regulation and administration of surface water as necessary for augmentation deliveries to meet Compact compliance purposes. Other surface water controls previously contained in the IMP, are unmodified, will be continued.
